Last week, the NFT and crypto world saw its headlines dominated by the rapid rise and fall of the company HitPiece. Dubbed “ The Fyre Festival of NFT Startups “, the company had an ambitious plan to sell NFTs of every song ever made.

Gene Quinn hit the nail on the head with this piece on patent subject matter eligibility.

We are dealing with this issue in an appeal on behalf of a client who has developed important and extremely useful processes in the area of clinical research studies.

The many conflicting case precedents result in confusion in the law, lack of settled expectations on behalf of earnest inventors, and unclear guidance /cherry picking of case cites by the USPTO and the Examining Corps, who are hopefully doing the best they can as well.

Congress needs to fix this mess but I have not seen any signs that Congress these days can tackle and solve ANY needed major legislative tasks.

Today the law of patent eligibility in America is a mirror image of what it was just a decade ago. Less and less is patent eligible in the United States, while the rest of the world continues to expand their view of what can be and should be patent eligible.

Patent troll bites the dust.

“Now, according to Shipping & Transit LLC's federal bankruptcy filings, its global patent holdings (34 in the United States and 29 elsewhere) are worth a whopping $2. Meanwhile, it owes more than $423,000 to numerous creditors, including banks, law firms, and something called the "West African Investment Trust," based in Geneva, Switzerland.”

Shipping & Transit LLC targeted companies including Radio Shack and JetBlue.
