It's important to be aware that under California's Proposition 213 (Civil Code § 3333.4), there are some limitations to keep in mind regarding car accident claims.
Essentially, the law states that if someone is driving without insurance, driving under the influence, or is a convicted felon at the time of an accident, they generally aren't able to sue the other driver for "non-economic" damages. This includes things like compensation for pain, suffering, and emotional distress.
