This is a fun case for the nerds (of which I am one so I use that term lovingly :)). A conviction was overturned because the Court determined that the Office of Statewide Prosecution lacked jurisdiction to prosecute a voting fraud case. The defendant had sworn that he could vote and then did so in Hillsborough County. The Florida Constitution and enabling statute for jurisdiction required that violations of criminal laws occurring or having occurred, in two or more judicial circuits as part of a related transaction, or when any such offense is affecting or has affected two or more judicial circuits as provided by general law. Court essentially held that even though the registration and votes are ultimately processed in the Second Circuit, that was insufficient to invoke OSP's jurisdiction to prosecute.

Charged with Domestic Violence? Some quick do's and don'ts:

1: Do: Get an Anger Management evaluation and comply with treatment, take a Batterer's Intervention Course, get evaluated for any substance abuse issues and comply with treatment. It's not because I know you need it (that's for the professionals), it's good to work on yourself to help me work on your case.

2: Don't: Try to talk to the alleged victim. Even if they want to talk to you, if you have a no contact order, you must avoid that person. If the alleged victim wants contact, we can file a Motion to allow it.

3: Do: Be patient. Emotions are high when these types of cases are initiated. The expression that time heals all wounds is apropos in this context. Once that occurs, a good result often follows.

4: Don't: Go at it alone. Get an attorney involved. It might be your first rodeo; it's not ours.

A good reminder that having a valid Florida Medical Ma*****na Card does not allow the holder to do whatever he likes with ma*****na. If you don't keep it in its original container, besides when lawfully using, you can still be convicted for possessing that ma*****na legally purchased. I always enjoy a good evidence opinion. This one is about the Child Hearsay exception. It's a good textual analysis of the statute by Judge LaRose. To get to the heart of it, the Court held that it's the age of the declarant at the time of the statement and not the age of the declarant at the time of trial that matters with regards to admissibility of child hearsay statements.

Almost seems like a no-brainer that the trial court should have awarded attorney fees in this matter. To not do so would reward dilatory practices by property insurers in similar situations. Fla. Stat. 627.428 allows for an award of fees to the prevailing party. Insurer in this case only invoked appraisal provision after denying claim, rejecting public adjuster assessment and denying claim again. After appraisal came in similar to public adjuster's number, insurer paid and suit was settled.
