There will be no excuses this year for Ohio students who miss at least 10% of the school days required.

House Bill 96, Ohio’s budget bill, changes the definition of chronic absenteeism as “missing at least 10% of the minimum number of hours required in the school year, regardless of whether the absence is excused or unexcused.”

The law change passed in 2025, and this fall is the final phase-in.

Ohio schools have been struggling to get students back into class since the pandemic. The statewide chronic absenteeism rate has been stuck at around 1 in 4 students chronically absent since the 2023-24 school year.

This law change doesn’t mean that parents will get in trouble with the Juvenile Court, but it does mean they may be contacted more due to a student missing school.

The Legislative Budget Office says the act requires a Juvenile Court complaint only if the school district determines that the student is not making satisfactory progress in improving the student’s attendance at school.

The complaint filed with the court must allege the child is a “habitual truant.” A “habitual truant” is a student of compulsory school age who is absent without legitimate excuse for 30 or more consecutive hours, 42 or more hours in one school month, or 72 or more hours in a school year, according to Ohio law.
