𝘽𝙚𝙜𝙞𝙣𝙣𝙞𝙣𝙜 𝙅𝙪𝙣𝙚 6, Pennsylvania drivers can be ticketed for holding or supporting a cellphone📱 while driving, even while stopped in traffic or waiting at a red light🚦

⚖️ 𝘗𝘢𝘶𝘭 𝘔𝘪𝘭𝘭𝘦𝘳’𝘴 𝘓𝘢𝘸 was signed on June 5, 2024 and took effect on June 5, 2025. For the past year, officers issued warnings. That grace period is now ending.

Starting June 6, violations can result in a citation and fine, and police may stop a vehicle solely for a violation of this law.

The safest approach? Put the phone down, mount it if you need GPS, and use hands-free features whenever possible.

In Pennsylvania, passengers do not have the same legal obligations as drivers during a traffic stop.

Under 𝘾𝙤𝙢𝙢𝙤𝙣𝙬𝙚𝙖𝙡𝙩𝙝 𝙫. 𝘾𝙖𝙢𝙥𝙗𝙚𝙡𝙡, police may ask a passenger for their name and date of birth during a traffic stop. However, because this is considered a “mere encounter,” passengers are not legally required to respond or provide identification.

The officer can ask. You can politely decline.

In Pennsylvania, flashing your headlights to warn other drivers about police or speed enforcement is generally considered lawful and has increasingly been recognized by courts as protected communication under the First Amendment, so long as no other traffic laws are being violated. ⚖️

🚘 In 𝘾𝙤𝙢𝙢𝙤𝙣𝙬𝙚𝙖𝙡𝙩𝙝 𝙫. 𝘽𝙚𝙖𝙘𝙝𝙚𝙮, Pennsylvania courts ruled that a driver did not violate Pennsylvania law by flashing headlights to warn oncoming motorists of a speed trap ahead.

But there is still an important detail Pennsylvania drivers should know…

Under 75 Pa. C.S. § 4306, drivers are required to dim high beams:
• Within 500 feet of an oncoming vehicle
• Within 300 feet when following another vehicle

So while the act of warning other drivers is generally lawful, improperly using high beams or creating a safety concern could still potentially lead to a citation depending on the situation.

Bottom line:
Generally lawful and protected? Yes.
Completely risk free in every situation?
Not necessarily.
