Great news in a recent Court of Appeals ruling in Holly Moose v. U.S. Legal Support Inc..

Big Win! The Court of Appeals rules court reporting firms must follow the law in Holly Moose v. U.S. Legal Support Inc.,

“There can be no dispute that U.S. Legal provides court reporting services to its clients. It does so by supplying CSRs, with whom it has separately contracted, for depositions and other legal proceedings in which the client is a participant,” Justice Elia said. “Although in its brief on appeal it denies that it provides shorthand reporting services, the company has represented itself as ‘one of the leading national providers of court reporting services.’”

The ruling went on to cite dictionary definitions of “rendering” to conclude that it is synonymous with “providing.” U.S. Legal thus appears to suggest that it is free to render, provide, or perform services without the obligation to adhere to the restrictions applicable to those individuals and corporations that are authorized to render those same services,” Justice Franklin D. Elia said for the unanimous three-judge panel. “Thus, for example, its violation of the requirement that each shareholder and director be licensed in the profession is the very reason it avoids liability for that very violation. Such circular reasoning to evade this state’s laws and regulations is, at a minimum, unpersuasive.”

Hitting the streets in San Diego yesterday with some very enthusiastic and kind-hearted youngsters to pass out some of the 1200 backpacks, each containing personal care items, to the homeless thanks to Operation Helping Hands.

Thank you also Valentine Law Group, APC and Kim Valentine for giving so many kids the opportunity to experience giving and helping the most needy among us. Everyone wins.

Frank's legacy serving as Chairman of the Democratic Party of Orange County for 20 years has cemented his legacy as a true shaper of the political scene in Orange County.
We know Frank as as an ultra kind and generous "people person" who has always been a tenacious supporter of underdogs everywhere.
