You’ve probably seen the headlines about how State Farm has been systematically denying, delaying, and low-balling legitimate claims. Legitimate claim denials do happen, but what are some warning signs that your insurer might be acting in bad faith?

🚩They bury you in paperwork. You receive constant letters, notices, and requests for additional evidence without any rhyme or reason.

🚩Quick, lowball offers. They offer you settlement almost immediately for much less than you expect. They tell you it’s their “full and final” offer.

🚩Delay -> Deny -> Appeal -> Repeat. You get caught in an endless cycle of delays, appeals, and then silence.

Why do insurers deny claims they know are legitimate? Simple - because they’re doing the math.

Only a small percentage of people that have a claim wrongfully denied will sue them for it - most will give up long before they get to that point. It’s cheaper for them to act badly and hope you won’t hire a lawyer.

If you’ve had a claim denied, don’t give up - if you do, you'll just become part of the math that incentivizes them to keep doing it.

What are the most important things to do if you have an insurance claim?

✔️Document everything. Make notes of any conversations you have with insurance representatives or adjusters. Take pictures. You can’t recreate evidence later if you need it.

✔️Keep everything they send you. You will receive written communications about your claim - don’t discard anything.

✔️Don’t accept an offer too quickly. You might not have considered long term costs related to injuries you sustain or other factors. Once you accept, that’s all you’ll ever receive.

When in doubt, consult a lawyer - even if it’s just as a sanity check. Adjusters handle claims all day, every day - they’re incentivized to settle claims for less than their true value.
