Summer is over because seasons always change, but the future looks good too.

You still have time to get your Healthcare Power of Attorney in place before the Oklahoma law changes on November 1, 2021.

Our legislature revoked the statute authorizing Healthcare Powers of Attorney beginning November 1, but documents signed before this date will still be valid. (They are planning to fix this at some point in the future but for now, it's up in the air.)

It's not too late to get your documents in place but time is running out. Give us a call now so that we can have your documents signed before the end of the month!

What's important to mom in her senior years? Many clients tell us they want to make sure that their home will go to their children when they're gone.

Is this this much different than what dad wants? We just posted about that yesterday! Slightly. Often dad is thinking about the land he accumulated in addition to his home. Mom is often talking about the home she is using as her residence.

Either way, mom and dad are talking about passing their important property to their family. They are always concerned about taking care of their family once they are gone. We see this over and over again.

What can you do? Plan! Let's make a plan for your property and make sure it will pass easily to your family. We can do that with a will, a trust or maybe just a deed.

What's important to your dad now that he's in his senior years? Many clients tell us that they want to leave their land to their family and that is their most important goal now.

What happens to all your prized possessions and important doo-dads if you die? Should you start giving them away now?

Some Seniors do. The benefit? They get to experience the joy of gifting something important to someone they love. If you wait until you die, you will not get to experience that joy or connection. The drawback? After gifting away your item, you won't get to enjoy it yourself anymore!

Some people ask, "Should I gift things away?" Generally, that's not a lawyer question. That's for you to decide. But what we like to advise, for every situation, is *transparency.* If you are gifting things to one child, be sure to tell your other children. Make sure your family knows your wishes well in advance of your passing. Tell them why you are making these decisions. And let them know how you want to live in your later years. Having these discussions now will benefit you more than you know.

So, let's plan for your senior years by making sure you have someone appointed to help you when you need help. An Advanced Directive for Health Care, often called a Living Will, appoints a Healh Care Proxy to make decisions for you if you cannot make them for yourself. It's the document that let's you say "do not keep me alive with tubes and liquids to prolong my dying."

This is one of the most important documents ANY PERSON can have.

On November 1, 2021, the law will change regarding Health Care Powers of Attorney. What are those? Those are the critical documents that allow you to name a person to help with your health care decisions if you are unable to make them for yourself. Does it take away all your rights? Does it give away all your power and decisionmaking? No and No. This document allows you to get help from someone when you need it.
