"Rhodes Hieronymus Client Prevails in Jury Trial Over Commercial Property Interest"

Randy Long and Austin Jackson obtained a $5.5 Million judgment for a Rhodes Hieronymus client following a three-day jury trial in Tulsa County. The firm’s client sued her ex-husband and his closely held corporation to recover damages due to the defendants’ failure to transfer limited partnership interests in commercial properties that were previously awarded to the firm’s client by another court in a divorce proceeding. The ex-husband alleged that he was unable to transfer the interests because of language in the limited partnership agreements that allowed the corporation to refuse to consent to the transfer. The evidence at trial showed that the ex-husband had put on his “corporate hat” and voted against the transfer on the corporation’s behalf so that he had a reason not to transfer the interests to the plaintiff. The jury was not amused with the defendants’ tactics and awarded significant compensatory and punitive damages.

"Summary Judgement in Favor of Horizontal Well Owner-Operators"

A vertical oil well owner sued two owner-operators of a horizontal well for a “frac hit” that allegedly damaged the plaintiff’s vertical well. Kerry Lewis and Lindsey Albers obtained summary judgment in favor of the horizontal well owner-operators because they did not own the well when the frac hit took place and could not be held liable under the Oklahoma Fraudulent Transfer Act because they had paid valuable consideration for the horizontal well.
