B. United States Department of Justice 1991-1993. Special Assistant United States Attorney

C. Prosecutor for Navy for federal crimes committed on naval bases in the United States District Courts. NOTABLE CASES

• Represented Naval Airman in General Court Martial on board the USS John F. Kennedy for the selling of narcotics with a return verdict of not guilty.
• Represented Naval Officer falsely accused of setting fire to a cruiser prior to returning to sea wherein the charges were dismissed.
• Represented Navy Hospital Corpsman for stealing insurance checks. Highly favorable sentence after court martial.
• Represented Naval Officer charged with running a naval destroyer aground in the Bahamas, settled with without no disciplinary action prior to court martial.
• Represented Navy Airman for sale of co***ne aboard the USS Lexington returning a not guilty verdict at Court Martial based upon successful full pretrial motion.
• Prosecuted Naval Post Office employee for multiple counts of theft of mail resulting in a sixteen (16) year sentence.
• Represented defendant charged with aggravated kidnaping, aggravated robbery and aggravated burglary in a one (1) day jury trial in Coffee County, Tennessee wherein the jury returned a verdict of not guilty. Marvin Swoape, 2000.
• Represented defendant charged with first degree premeditated murder of his spouse in Coffee County, Tennessee wherein a plea bargain was reached for a fifteen (15) year sentence. State of Tennessee v. Eric Smith, 2001.
• Represented the widow o f a prominent business man in middle Tennessee who was charged with solicitation to commit murder and thereafter charged with first degree murder. On the eve of the trial, a plea bargain was reached wherein the defendant pled no contest to reckless homicide and received a one year sentence. Louise Marlow,2001.
• Represented a female defendant in Franklin County, Tennessee who was charged with aggravated assault. She was acquitted after a one (1) day jury trial. Tina Sanders.
• Represented a defendant in Franklin County, Tennessee who was charged with first degree premeditated murder. The defendant was acquitted of murder one but, convicted of murder 2 after a one (1) week jury trial. Lonnie Owens.
• Represented a defendant in an aggravated assault, stabbing, in Franklin County, Tennessee. The defendant was acquitted after a two (2) day jury trial. Pam Richards
• Represented a retired state trooper who was charged in a boating accident resulting in a death in Franklin County, Tennessee. The defendant applied for pre-trial diversion which was denied by the Circuit Court. However, The Court of Appeals reviewed the matter resulting in an overturn of the State Court’s denial granting the defendant pre-trial diversion. R T_____________
• Represented a defendant in Lincoln County, Tennessee charged with multiple accounts of aggravated assault and reckless endangerment. The defendant was offered a twenty-three year sentence. After a two (2) day jury trial, the defendant was found guilty of minor offences a given a six (6) year sentence. Gary Morgan
• Represented a defendant charged with first degree murder in the death of his own child in Coffee County, Tennessee. The case was dismissed prior to trial. see The Nashville Tennesseean October 22, 2006.
• Represented an official with the City of Manchester Recreation Department charged with sale and distribution of ma*****na. The defendant was acquitted after a one day jury trial. Sammy Wooten, 2010
• Represented a retired school teacher in Moore County, Tennessee who was charged with aggravated assault of a police officer. Stuart L***y, 2008.
• Represented a businessman who was charged in Federal Court in Nashville, Tennessee with government fraud. Such offences render a fifteen (15) year sentence. Defendant, after successful negotiation, received a four (4) year sentence. United States of America c. Bryan Guess, 2007.
• Represented an attorney charged with identity theft in Coffee County, Tennessee who was acquitted after a one (1) day bench trial. Christina Stanford, 2004 and The McMinnville Southern Standard , associated press.
• Represented a defendant charged with second degree murder resulting from a fight in Coffee County, Tennessee wherein a successful negotiation was reached reducing his offence to manslaughter. Jose Diaz, 2000.
• Represented a defendant charged in Coffee County, Tennessee with aggravated assault, aggravated robbery, and aggravated burglary stemming from the invasion of the home of his wife. Kenneth Sartain,2015.
• Represented a defendant charged with felony reckless endangerment and DUI 2nd offence stemming from a vehicle accident in Coffee Count, Tennessee wherein he was acquitted after a two (2) day jury trial. Dane Victory, 2014
• Represented a defendant charged in Rutherford County, Tennessee resulting from a “date r**e” wherein the defendant was acquitted after a bench trial. G._______S__________, 2014.
• Represented a defendant who was accused of child molestation and r**e in Franklin County, Tennessee that resulted in a “hung jury” after a one (1) week jury trial 11-1 acquittal and the case was never retried. Merle Langford, 1998
• Represented a defendant charged with selling several hundred “hits” of L*D at the Bonnaroo Music and Arts Festival wherein a one (1) year probation term was negotiated. (confidential)
• Represented a defendant charged with selling fifteen (15) pounds of mushrooms and 75 pounds of ma*****na at the Bonnaroo Music and Arts Festival wherein a six month (6) month jail and eighteen (18) month probation term was negotiated.
• Represented a defendant charged possession of thirty (30) grams of co***ne at the Bonnaroo Music and Arts Festival wherein a forty-five (45) day jail term was imposed. (confidential)
• Represented a defendant charged with 650 hits of L*D for resale at the Bonnaroo Music and Arts Festival, a confidential settlement was reached resulting in no jail time.(confidential), 2014.

HAPPY BIRTHDAY UNITED STATES NAVY!
I am very proud of my time I spent as an officer of this fine organization. When people say “Thank you for your service”, I want to say: I should be thanking the taxpayers for allowing g me at serve my country this way.
I learned so much about leadership, legal skills, and trial practice that it really helped make me the lawyer I am today. At the age of 25 years old, I was representing service members in courts martial. I could not and would not trade anything for the experience.

I just left the courthouse in a neighboring county. As I pulled out of the parking lot, I noticed a grown man sitting in a truck next to me bawling his eyes out. This was a good reminder that the stuff we do is IMPORTANT and AFFECTS LIVES. I hope everybody in this system remembers this.
