🚨 A 3-Day Notice is NOT the same thing as an eviction.

This is one of the biggest misunderstandings we hear from landlords.

A notice is generally a step that happens before an eviction court case.

If the tenant does not comply with a valid notice by the deadline, the landlord may then be able to move forward with an Unlawful Detainer case.

Think of it this way:

NOTICE ➡️ COURT PROCESS ➡️ JUDGMENT ➡️ POSSESSION

There are several steps between “I served a notice” and “I have my property back.”

Not sure where you are in the process?

📄 You served the notice. The deadline passed. The tenant is still there.

Now what?

Depending on the circumstances, if the requirements of a valid notice were not met, the next step may be filing an Unlawful Detainer action with the court.

And this is where landlords often realize:

An eviction is more than serving one piece of paper.

There are filings, deadlines, service requirements and additional documents throughout the process.

You don’t have to figure out the paperwork alone.

Rapid Evictions helps landlords move the process forward professionally.

🔑 Your tenant won’t leave. Can you just change the locks?

No—not as a way to force a tenant out.

California landlords generally cannot bypass the eviction process by locking a tenant out, shutting off utilities or removing their belongings to make them leave.

We understand the frustration.

You own the property. You may be losing rent. You may simply want the situation resolved.

But the safest approach is to stay professional and follow the required process.

That’s exactly what Rapid Evictions helps landlords navigate.

⏳ “How long is this eviction going to take?”

It’s probably one of the first questions every landlord asks.

The difficult answer?

There isn’t one timeline that applies to every case.

Timing can depend on the notice, service of paperwork, whether the tenant responds, court scheduling, trial or default procedures, and what happens after judgment. California Courts says eviction cases can take 30–45 days or more once court papers are served, depending on the circumstances.

What CAN you control?

✅ Starting with the correct paperwork
✅ Staying organized
✅ Following required procedures
✅ Responding promptly as the case progresses

❓ 3-Day? 30-Day? 60-Day? Which notice do you actually need?

The answer is:

It depends on WHY you’re serving the notice.

Nonpayment of rent, certain lease violations, ending certain tenancies and other circumstances can require different paperwork and different timelines. California Courts specifically warns landlords to select the notice that matches their situation and comply with state and applicable local requirements.

This is why grabbing a random form from the internet can be risky.

📄 The right paperwork matters from the very beginning.

📱 “I texted my tenant the notice. Does that count?”

Don’t assume it does.

How an eviction notice is delivered can matter just as much as what the notice says.

California Courts states that notices must contain required information and be delivered in the proper manner; problems with the notice or service can affect an eviction case.

This is why professional process service can be so valuable.

You don’t want to get further into the process only to discover there was a problem at the beginning.

🐶🏠 Someone moved in who isn’t on the lease—or there’s now a pet that wasn’t allowed. What can a landlord do?

First:

Go back to the rental agreement.

Certain violations of a rental agreement may support further action, but the type of violation and whether the tenant must be given an opportunity to correct it can matter. California Courts specifically identifies unauthorized occupants and prohibited pets among situations that may involve lease-violation notices.

Our suggestion?

📸 Document the situation.
📄 Review your agreement.
🚫 Don’t react emotionally.
✅ Follow the proper process.

📅 The lease ended…but the tenant is still living in the property.

What happens next?

This is a situation where landlords sometimes assume:

“The lease is over, so I can just take the property back.”

Not so fast.

Ending a lease and legally recovering possession are not always the same thing. Depending on the tenancy, property and applicable laws, additional notice or court procedures may be required. California Courts notes that staying after a lease ends can be a basis for action, while also warning that tenant-protection or local eviction-control laws may affect some situations.

Before taking matters into your own hands, find out what step comes next.

🏠 “My tenant is month-to-month. Can I just give them notice to move?”

This is where landlords need to be careful.

Month-to-month does not automatically mean there are no restrictions.

The proper notice and whether a tenancy can be terminated can depend on the circumstances, how long the tenant has lived there, the property involved, state requirements and potentially local protections. California Courts specifically notes that additional eviction-control rules may apply in some locations.

Before serving paperwork, find out what process applies.

🏆 The landlord won the eviction case. Is it over?

Almost—but there are still important steps.

When a landlord wins, the court can issue a Writ of Possession. The sheriff then handles the legal process for restoring possession, including posting a Notice to Vacate.

The important part for landlords to remember:

You don’t personally perform the lockout.

The legal process continues through the appropriate authorities.

From the first notice to the final paperwork, every stage matters.
