There is a case sitting in front of the U.S. Supreme Court right now that every trucker, owner operator, and freight broker in this country should be paying attention to.
It started in 2017 on the side of an Illinois highway.
Shawn Montgomery had pulled over and was standing outside inspecting his truck when a tractor-trailer came barreling down the road at high speed and rear-ended him. He survived, but the injuries were severe enough that he eventually lost part of his leg and was left with permanent disfigurement.
Here is where it gets important for the industry.
The trucking company that caused the crash, Caribe Transport, had a remarkably poor safety record. And the freight broker that hired them was C.H. Robinson, one of the biggest names in the brokerage world.
Montgomery sued both. But C.H. Robinson argued they could not be held liable because of a 1994 federal law that limits state authority over brokers.
That argument made it all the way through multiple federal courts, with different circuits landing on completely different sides of the issue. Some courts said brokers can be sued. Others said they cannot. That split between courts is exactly what opened the door for the Supreme Court to step in and settle it once and for all.
Oral arguments were heard in March 2026. A final decision is expected by the end of June 2026.
So why does this matter to owner operators and small fleets?
Right now, brokers operating under a no-liability framework have very little incentive to screen the carriers they hire for safety. A ruling that holds brokers accountable would push them to avoid unsafe carriers, which changes the entire dynamic of how freight gets booked on the road.
On the other side, those arguing against broker liability say it would shrink the available pool of carriers down to only the largest companies, leaving smaller owner operators and independent fleets locked out of loads entirely.
Either way this goes, the trucking world will not look the same after June.
This one is worth watching closely.
