Topic: Debt

When the majority of individuals pass away, they often leave behind some form of debt, which creditors will pursue against your estate. According to Debt.org, "Americans owe $986 billion on credit cards, surpassing the pre-pandemic high of $927 billion. We owe $11.92 trillion on mortgages, $1.55 trillion on vehicle loans, and $1.60 trillion in student loans." (https://www.debt.org/faqs/americans-in-debt/demographics/). There are very simple ways to prevent your Money Accounts from falling into probate and becoming subject to creditors.

Any financial account or policy can have a beneficiary or a Payable on Death (POD) designation. This means that any money held within the account automatically transfers to the designated individual upon your passing. As a result, the account will not be part of the estate and will avoid probate or court oversight.

If done correctly, you can avoid any payments to creditors for a debt you owe at the time it is due. This is because all of your assets will immediately transfer, leaving nothing in your estate that can be taken to settle the debt.

All this being said a secured loan will always need to be settled or transferred. Usually these are Cars, and Property, however you can easily make these assets avoid probate as we will discuss Next Week!

Internet wills might seem like a cheap and inexpensive fix for drafting wills or other legal documents. However, the time and money that you save on the front end may come at a cost of your time and money on the back end.

For Example:

1. Probate Problems: If a Will isn’t drafted by a skilled attorney, important details might be left out. They often do not conform to your specific state laws and may be deemed invalid all together. This can make the probate process more expensive and time-consuming than expected.

2. Incomplete Estate Plans: Internet documents often do not fully reflect a person’s wishes or account for complex family situations, which can lead to delays and higher costs in probate.

You wouldn’t trust a computer to take care of your baby, and you shouldn’t trust a computer to take care of your legal assets or property. Use a Licensed Experienced Attorney!

Topic: Elder Fraud and Exploitation

As time progresses and technology evolves, so does the ability to defraud and exploit seniors. According to the Federal Bureau of Investigation, in 2023, a total of $3.4 billion in losses were reported, and elder fraud complaints increased by 14% from the previous year. Despite increased awareness, the rate of fraud continues to rise, highlighting the need for solutions to prevent such incidents in the future. Here are a few recommendations to help protect against Elder fraud:

1. Prepare an Advanced Directive for Healthcare and a Defensive Power of Attorney with a licensed Attorney while Legally Competent. Appoint a trusted person as your Power of Attorney to manage your affairs during unexpected events.
2. Never provide Personal Information over the phone or via electronic devices.
3. Consult a Licensed Attorney or Financial Advisor before signing any document you do not fully understand.
