What is a Deed Upon Death?

It's also called a Transfer on Death Deed — and it's one of the simplest ways to pass your home to someone you love without probate.

Here’s how it works in Virginia:

1. You still own your home. You can live in it, sell it, or refinance it. Signing it gives your beneficiary NO rights while you are alive.

2. You choose who gets it. You name a person or people to inherit your house when you pass.

3. You record it now. It must be recorded at the courthouse before death to be valid.

4. At death, it transfers automatically. Your beneficiary files a death certificate and affidavit — no probate court needed for that property.
