Old News You in Case You Missed It (ICYMI)

๐Ÿšจ Attention Connecticut Landlords! ๐Ÿšจ

Did you know that recent changes to Connecticut law limit how much you can charge for late rent? ๐Ÿ ๐Ÿ’ธ

Hereโ€™s what you need to know:

Monthly tenants: Late charges can only be imposed starting 10 days after rent is due.
Weekly tenants: Late charges can only be imposed starting 4 days after rent is due.

In either case, the late charge cannot be more than $5 per day, up to a maximum of $50, OR a maximum of 5% of the tenant's share of overdue rent, whichever is less.

Only one late charge can be applied per unpaid rent period, no matter how long the rent remains overdue.

These changes in law have made late charges more complicated than ever to calculate. ๐Ÿค”

๐Ÿ’ฅ New Connecticut Law: Late Charges Have Been Capped! ๐Ÿ’ฅ

Hey Landlords! ๐Ÿ“ข This past October, the Connecticut legislature passed sweeping changes to landlord-tenant laws, but Iโ€™m still seeing leases that arenโ€™t following the new laws.

Serious legal consequences could result if your lease hasnโ€™t caught up with these changes. โš ๏ธ

Did you know that late charges are now limited by the Connecticut statutes? ๐Ÿšซ

Hereโ€™s whatโ€™s changed and what hasn't:

As long as you have a written lease with a valid late charge provision, you can still assess a late charge against monthly renters if they donโ€™t pay rent within nine (9) days after itโ€™s due. ๐Ÿ’ฒ

However, late charges are now limited by law to five dollars ($5) per day up to a maximum of fifty dollars ($50), or five percent (5%) of the tenantโ€™s share of the rent, whichever is less.

For example, a Section 8 tenant who pays $100 toward a monthly rent of $1,200 can only be assessed a five-dollar ($5) late charge, no matter how late they pay after the grace period.

On the other end of the scale, a tenant who pays a monthly rent of $4,000 one day after the grace period can be charged a maximum of five dollars ($5).

Another new part of the law limits late charges to one per overdue rent payment, no matter how long it remains unpaid, so additional daily late charges must end.

With the start of a new legislative session in Connecticut, landlords should be on the lookout for legislation building upon last year's Public Act 23-207.

This year, Connecticut Senate Bill 143 would require "good cause" for the eviction of certain tenants and residents of mobile manufactured home parks.

The recently issued Connecticut Bar Foundation Annual Report shows how the Foundation uses the interest earned on lawyers' trust accounts.
