California and “common law marriage” — let’s clear it up!
- California does NOT recognize common law marriage. Simply living together, no matter how long, doesn’t make you “married” here.
- What is common law marriage? In some states, a couple can be considered legally married without a ceremony or license if they meet specific criteria (like living together and presenting themselves as married).
- Important: If you formed a valid common law marriage in a state that recognizes it, California will generally honor it when you move here.
