Workers' compensation laws help protect people who are injured on the job. They are designed to ensure that employees who are injured or disabled on the job are provided with fixed monetary awards, eliminating the need for litigation. These laws also provide benefits for dependents of those workers who are killed because of work-related accidents or illnesses. Some laws also protect employers and

fellow workers by limiting the amount an injured employee can recover from an employer and by eliminating the liability of co-workers in most accidents. Kansas, like most states, has it’s own version of the workers’ compensation statute, beginning at K.S.A. 44-501. Under that statute, employers are required to purchase workers compensation insurance; then, when an employee is injured, the employer has to report that injury to the Division of Workers Compensation and their insurer. Ideally, the insurance company then begins paying out workers compensation benefits to the disabled employee. In some cases, however, the insurance company will dispute that the employee’s claim is proper, sometimes by arguing that the employee failed to notify his or her employer of the injury within the statutorily-specified time limits.
