It's not often you get to talk about real estate law and the Super Bowl at the same time, so we'll take the chance when we get it! Eagles head coach Nick Sirianni put an offer on a house in the beginning of 2021. During the title search, it was discovered that a previous owner included a provision in the deed that gave his son, daughter, and the family trust the option to match the purchase price "for any future conveyance" of the property. Though the son, daughter, and trust apparently waived their right of refusal for Sirianni's purchase, Sirianni was concerned that the deed restriction's language - "ANY future conveyance" - would require the family's waiver again. And since that would infringe on his rights of ownership (specifically the right to transfer), he argued the seller couldn't convey clear title and demanded the cancellation of the contract and return of the deposit. The seller sued, since Sirianni refused to close with that language in the deed. The trial court agreed with Sirianni, authorizing the cancellation of the contract and the return of the deposit.

When you sign a broker-prepared contract in New Jersey, you have three business days to hire an attorney to review the contract. If the attorney wishes to make amendments to the contract, the attorney will technically disapprove the contract. If no attorney disapproves the contract within the three business day review period, then the contract is binding on both parties.

It's important to remember that only an attorney can cancel or disapprove the transaction within the three-day review period. Notice from one party or one broker to the other does not legally cancel the contract once it's been signed, even if it's within the three-day review period (there's a reason it's called attorney review!)

It's Friday! And what better way to start the weekend than by learning about the Constitution?! Starting today, each Friday we'll offer some facts, video, analysis, or cases about the Constitution.

To kick this off, we'll start with WHY the Constitutional Convention took place at all. The short version is that after winning the American Revolution, the Americans (no longer colonists or colonials) established a very loose confederation between the states, governed by the Articles of Confederation. They were understandably weary of centralized government, having just defeated a monarchy that they viewed as tyrannical. But experience showed that there were significant problems with the confederation.

An initial attempt to meet with a delegation from several states in 1786 convinced them that a more thorough convention was required. So, another convention was called for May of 1787 so the delegates could amend some of the more contentious or unworkable parts of the Articles. But bigger plans were in the works, plans that went far beyond simple amendments . . .
