He began his legal career in the Cook County State’s Attorney’s Office in the Criminal Appeals Division, with later assignments in the Municipal Division, Felony Review Unit, Repeat Offender Unit in the Juvenile Division, and Felony Trial Division. He has tried over sixty-five (65) jury trials to verdict and argued numerous cases before the Illinois Appellate and Supreme Courts and the Seventh Cir

cuit Court of Appeals. He served on State’s Attorney Cecil Partee’s Task Force on the Foregoing of Life Sustaining Treatment and updated and re-drafted the Uniform Criminal Complaint Book for County law enforcement agencies. From 1988 to 1992 he was cross designated as a Special Assistant United States Attorney. Eberhardt has engaged in the general practice of law concentrating his practice in criminal, family law and litigation matters. He is licensed to practice before the United State Supreme Court, the Fifth, Seventh and Ninth Circuit Courts of Appeals, all of the Federal District Courts in Illinois, the Federal District Court for the Northern District of Indiana, and has represented clients in the Federal District Courts in Arizona, Michigan and Mississippi. Prior to being admitted to the Illinois bar, Mr. Eberhardt gained extensive law enforcement experience through his work as a part-time police officer, police 911 system operator, patrol officer and detective. While with the Hazel Crest Police Department he attended the Illinois State Police Academy and was President and Valedictorian of his basic training class. While working for the Village of Tinley Park Police Department, he served as a Patrol Officer and Investigator. His duties included working as a major traffic accident reconstructionist, training officer, and overweight truck enforcement officer. Additionally, while an attorney, he served as the Detective Division Commander on a part-time basis for the Village of Crestwood for a number of years. Eberhardt has received extensive continuing law enforcement as well as legal training over the course of his professional careers from a variety of county, state and federal agencies and task force operations as well as teaching at numerous law enforcement and legal seminars.

Judge refuses to dismiss FEDERAL CIVIL RIGHTS and other claims against Clerk Kristin THIRION and Assistant VM Patrick CARR.
The lawsuit alleges purposeful disclosure of private information in retaliation for the filing of an "Ethics Complaint" against THIRION and GLOTZ. While every other Complaint posted on the Village web site by THIRION redacted the filer's private information, inexplicably this was not done when the Complaint sought an investigation of THIRION and GLOTZ. When CARR was notified of the security breach, he refused to take actions to correct it. (See Order here:"http://eberhardtlaw.com/documents/J-Hynes-Order.pdf").
The Plaintiff has requested a jury trial to address the retaliation by Village officials.

FAULTY METERS and FRAUDULENT BILLINGS...
A Cook County Judge DENIED the Village's request to DISMISS a lawsuit seeking a refund for over payments of water bills based on faulty "smart meters" as well as faulty "iPERL" meters. Ever since 2003, the Village has known of the problems with meters. Despite continual complaints, the Village was successful in dismissing those complaints simply by stonewalling and delay and the continued claim of the "your toilet is leaking" excuse.
In 2015, a month before the CHICAGO TRIBUNE was to publish its first in a series of expose articles, a former Trustee wrote an article for the EXCHANGE trying to downplay the extent of the failures. Just about a week before the first article went to press, the former Mayor "retired".
Over the years since the first installation of "smart meters" an as yet unknown number of residents and businesses were overcharged for water usage based on the faulty meters. Documents released by the Village now note failures with the new "iPERL" meters also.
In the lawsuit filed earlier this year, a resident asks for refunds of monies overpaid based on the faulty meters. Relying on the same arguments the Village had used in another case, Village lawyers asked the lawsuit be dismissed. The judge disagreed and found that since the allegations are based on fraud the lawsuit may proceed.
This could open the door for persons who believe they have been over billed for water usage to seek a refund from the Village.
