MYTH: If there's a will, you can automatically skip probate. FACT: In Georgia, a will generally has to be probated before the executor can act on it.
A will says who should receive real property and personal belongings upon one's passing. Probate is the court process that gives the executor legal authority to carry out those wishes. This gives the executor the ability to transfer title to real property, sell assets if needed, and pay estate debts.
However, there are certain cases where probate may be avoided. Certain estates may not require probate. Some assets, such as accounts with a named beneficiary or jointly owned property with survivorship, may pass outside probate.
