If you're ever on a jury remember this. Courts will NOT tell you that you have this option.

What is jury nullification?

In its strictest sense, jury nullification occurs when a jury returns a Not Guilty verdict even though jurors believe beyond reasonable doubt that the defendant has broken the law. Because the Not Guilty verdict cannot be overturned, and because the jurors cannot be punished for their verdict, the law is said to be nullified in that particular case.

What if someone were charged with breaking a law that you thought was unjust?

The Ohio Supreme Court just issued a new decision on "internal possession" cases. This is a big win for the defense and changes the law throughout the State of Ohio. The Court ruled that merely testing positive for drugs in one's system is not "possession" of that drug. Attorney John Kahler was the trial attorney for the defendant. Attorneys Adam Stone and Timothy Young were appellate counsel. Here's the case if anyone would like to read it: https://www.supremecourt.ohio.gov/rod/docs/pdf/0/2021/2021-ohio-3409.pdf

If you are charged with an "internal possession" case please be sure to contact an attorney.

Something to think about.

As world leaders meet to consider the future of global drug policy at UNGASS, the UN's special session on drugs, they will look to Portugal as an example of what decriminalization can accomplish.

"We, as criminal defense lawyers, are forced to deal with some of the lowest people on earth, people who have no sense of right and wrong, people who will lie in court to get what they want, people who do not care who gets hurt in the process. It is our job–our sworn duty–as criminal defense lawyers, to protect our clients from those people." — Cynthia Roseberry, NACDL
