So I’ve been busy with court and endodontist and haven’t realized I didn’t post Texas is about to make short barreled rifles and shotguns no longer criminal weapons under Texas law… All we need now is the governor signing the bill.

But don’t get too excited because they’re still federally regulated.

H**p bad. Sawed off shotguns and short barrelled rifles, OK.

5th Circuit reaffirms prosecuting a ma*****na user for illegal gun possession was unconstitutional - Reason

"The U.S. Court of Appeals for the 5th Circuit this week reaffirmed its conclusion that the federal government violated the Second Amendment when it prosecuted a Mississippi cannabis consumer for illegal gun possession. In a decision published on Monday, a three-judge panel unanimously ruled that Patrick Darnell Daniels Jr.'s conviction for violating 18 USC 922(g)(3), which makes it a felony for an 'unlawful user' of a 'controlled substance' to possess a firearm, 'is inconsistent with our "history and tradition" of gun regulation.' It therefore fails the test that the Supreme Court established in the 2022 case New York State Rifle & Pistol Association v. Bruen."

And, DPS found out they were wrong again. Another LTC appeal client will get their license.

Just wrapped up an LTC appeal in MONTGOMERY COUNTY where the DPS lawyer said their entire case, I agreed wholeheartedly with them, and then I taught him more law (under a different section) which says DPS SHALL issue....and he goes "oh" and agree with me.

The visiting judge commented on how he had watched a few of my State Bar videos on gun laws....lol.

I also had another one set for tomorrow in Harris County for a different issue and the DPS lawyers called wanting a continuance because they think I am probably right.
