🏠 Important Update for Landlords & Property Managers

HUD has changed its guidance regarding Emotional Support Animals (ESAs) in rental properties.

Under the new guidance, landlords are no longer required to waive pet policies or pet fees for untrained emotional support animals. HUD will focus Fair Housing investigations on animals that are trained to provide disability-related assistance.

🐾 Key distinction: Providing comfort, companionship, or emotional support alone does not qualify as trained assistance under this guidance.

Texas REALTORS® recommends landlords take a measured approach before changing existing leases or policies and consult legal counsel when necessary, as HUD guidance continues to develop.

Definitely an important change for Texas landlords to be aware of!
