Come to learn the importance of setting up an Estate Plan (a Trust or a Will, and other documents that go along with those) to protect your loved ones against uncertainty, stress, strain and loss in case you are no longer able to be there for them due to incapacity or death.

Hello friends - Welcome to 2024! This year is virtually guaranteed to bring us much more of the same chaos and uncertainty we saw in the last 3 years. One way you can combat the uncertainty is through estate planning. Once or twice a year, I like to remind my Facebook friends of the importance of setting up an Estate Plan (a Trust or a Will, and other documents that go along with those) to protect your loved ones against uncertainty, stress, strain and loss in case you are no longer able to be there for them due to incapacity or death. You’ve no doubt heard, there’s only two certainties in life… death and taxes. Well I’m not a tax attorney, but I can help to assure things will go the way you want them to in the end. DID YOU KNOW?

If a married person dies in Texas without a Will, and the deceased person has children from a prior marriage, or from outside the marriage, the children from the prior marriage will inherit the deceased person's portion of all community property and 2/3 of any non-community property owned by the deceased. This includes the home of the surviving spouse. So this means the surviving spouse will have to own the house she/he lives in along with the "step-children" of the now-deceased spouse. As you can imagine, this is a result that can be very problematic, especially if the relationship between the surviving spouse and "step-children" is strained, as unfortunately happens very often.
