Last week a federal district court in northeast Texas issued an order blocking the requirement that business owners file the Beneficial Owner Information Reports ("BOIR") with the Financial Crimes Enforcement Network ("FinCEN"). Under the ruling, the BOIR reporting rule cannot be enforced on a nationwide basis with respect to the impending January 1, 2025 deadline. The Justice Department has already filed a notice of appeal. FinCEN has released a statement saying that filing the BOIR is currently voluntary while the appeal works its way through the court system.

Creating a financial power of attorney (durable power of attorney) is a routine occurrence in putting together the necessary documents for an estate plan. However, what is often times not mentioned or explained is the difficulty an agent under a financial power of attorney may have if the document ever needs to be used. Some banks and financial institutions will even refuse to accept the document. Probate Avoidance

The Assurances of a Will
A Will provides your family with certainty after your passing and names the people in charge of administering your final affairs, distributing your assets, naming the individuals who will receive your assets, and providing for the guardianship of minor children. Although passing away without a Will is not necessarily a hardship, however, passing without a Will leaves it to the Courts to decide who your heirs are and who will administer your estate, making the probate process more expensive and burdensome on your family.
