Understanding HOA Receiverships
While community associations are designed to be self-governing, sometimes boards become deadlocked, board members move, or internal disputes may put the community at risk. In these rare but serious situations, courts can appoint a receiver, a neutral fiduciary who temporarily assumes control of the association to stabilize operations, manage finances, levy assessments, and schedule repairs under court supervision. Receiverships are costly and disruptive, so they’re a last-resort remedy, but they provide structure, accountability, and experienced oversight to help communities recover and return to normal governance.
