Trial Victory:

Following a Court Trial, Judge rendered a verdict awarding damages in favor of my client in her suit to recover damages resulting from a breach of contract to make a will or trust that should have left her two real properties in exchange for financial assistance in the form of monthly payments. My client made monthly payments, but her parents breached the agreement by selling the properties and refusing to pay the money back.

Legal Take Away:

Normally an estate plan is revocable by the grantors unless consideration is paid in exchange for future inheritance. If you agree to accept consideration such as financial assistance or care in return to make a will or trust leaving the property after you pass, then you must perform, and failing to do so will end up in the payment of damages.

JURY VERDICT IS IN!

It was a successful day. We proved to a jury in Riverside County Court Department 6 that Respondent financially abused her father through undue influence with malice and that she financially abused her father’s 92 year old girlfriend by taking over $50,000 that belonged to her. Justice was served.
