A little food for thought on this Friday... Would you leave your children their entire inheritance all at once?

There is no one right answer.

For some families, an outright inheritance makes perfect sense. For others, a little structure can offer valuable protection, especially when there are concerns about financial maturity, divorce, creditors, addiction, special needs, or simply handing someone more money than they are ready to manage.

A trust can allow you to leave an inheritance in stages, tie distributions to certain needs or milestones, or give a trusted person discretion over when funds are distributed. And sometimes, treating children fairly does not necessarily mean treating them exactly the same.

In California, marriage can change more than your relationship status. It can also change how your property is legally owned.

In general, assets earned or acquired during marriage are considered community property, which means each spouse owns an equal share. Property owned before marriage, along with certain gifts and inheritances, may remain separate property.

Why does this matter for estate planning?

Because you cannot always leave an entire asset to someone else if part of it legally belongs to your spouse. Real estate, retirement accounts, investments, and even a family business can all be affected by California’s community property rules.

It is easy to tuck estate planning documents away and assume they are finished forever. But life has a way of changing the details.
