Victory is the fuel that keeps us going, and we are thrilled to report another one.

On March 11, 2026, a FINRA arbitration panel granted our client’s request to expunge a customer complaint from his Central Registration Depository ("CRD") record. Obtaining expungement is an extraordinary remedy, and the process became even more rigorous in 2023 when FINRA amended Rules 12800, 12805, and 13805 governing expungement proceedings. FINRA Rule 2080 provides only three grounds to obtain expungement of customer dispute information from the CRD system: (1) the claim, allegation, or information is factually impossible or clearly erroneous; (2) the registered person was not involved in the alleged investment-related sales practice violation, forgery, theft, misappropriation, or conversion of funds; or (3) the claim, allegation, or information is false.

Chemere Ellis and Kristen Rickard worked tirelessly to meet this demanding standard. Following an evidentiary hearing conducted by Chemere Ellis, during which she examined witnesses and presented documentary evidence in support of the expungement request, the arbitration panel made affirmative findings of fact that the claim, allegation, or information was factually impossible or clearly erroneous and false, and granted the expungement request.
