‪Victory! In a 2-1 decision with a 12-page dissent, we persuaded to reinstate the entirety of a medical malpractice case and deny rehearing. The trial court had dismissed the case despite the trial lawyer’s endocrinological condition.‬

‪Victory! After persuading to reverse 3 convictions from a 10-day jury trial for insufficient evidence, on remand for resentencing, we convinced the district court to award a 7-month downward variance (in addition to its original 38-month downward variance).‬ ‪Her original 94-month sentence has now become an 87-month sentence. The further downward variance was due to the client’s post-sentencing rehabilitation and her physical ailment.‬ ‪As a practical matter, with the gain time calculation, this means the client will get to spend Thanksgiving and Christmas with her family and friends a year sooner than she had expected.‬
