A FEDERAL APPEALS COURT rules that a Federal law which prohibits possessing if they are an "unlawful user" of a controlled substance violates the Second Amendment right to bear arms.
Basically, you cannot be prohibited from having a firearm just because you use drugs.

I’ve been charged with an economic crime. What do I do now?

Most serious economic crimes are charged in Federal Court. These include different times of fraud crimes such as investment fraud, wire fraud, mail fraud, bank fraud and mortgage fraud. Other types of Federal economic crimes that are very commonly prosecuted are tax evasion and money laundering.

Excellent result over the objections of the State.

Client was charged with two different cases of Felon in Possession of a Firearm, Burglary of a Dwelling and Aggravated Fleeing and Eluding.

Under the Florida Sentencing Guidelines the minimum the Court could sentence him to was 8 years in prison up to a maximum 60 years.

The State offered 6 years in prison and my advice was to reject the offer and ask the court for a youthful offender sentence since he was only 18 at the time of the crimes. The State objected because my client had 20 juvenile convictions.

I filed two Motions to Depart from the guidelines and after successful argument the court not only allowed my client to be released on house arrest after 400 days in the county jail but withheld adjudication of guilt meaning he is still not a convicted felon.
