Who manages your rental properties after you die in Florida?

Here's what happens ⬇️

⚠️ Property titled in your name is stuck until a judge appoints a personal representative
βœ… Until then, nobody can sign a lease, collect rent, or approve a repair
⚠️ The probate file is PUBLIC: every asset, debt, and beneficiary
βœ… A revocable trust lets your successor trustee step in right away
βœ… It only works once the properties are actually titled in the trust

Where should every rent check go if you own Florida rentals?

Here's the system ⬇️

βœ… Jar 1, Operating: mortgage, insurance, repairs, and property manager only
βœ… Jar 2, Tenant deposits: that money is NOT yours, so keep it out of operating
⚠️ Florida gives you 3 ways to hold deposits: a separate account, a separate interest-bearing account, or a surety bond
βœ… Jar 3, Reserves: about 3 months of expenses so a vacancy never becomes a personal loan
βœ… Jar 4, Taxes: set it aside the day the rent lands, not in April
βœ… Jar 5, You: pay yourself on a schedule
⚠️ Commingled accounts can make your LLC protection disappear on a bank statement

Are estate planning and asset protection the same thing under Florida law?

Here's what you need to know ⬇️

βœ… Estate planning focuses on what happens to your assets AFTER you pass
βœ… Asset protection is about shielding your wealth from lawsuits and creditors NOW
⚠️ Florida has unique laws that can combine both strategies
βœ… A well-drafted trust can serve BOTH purposes
βœ… Working with an attorney who understands both areas is key

Your successor trustee doesn't need a court. They walk into the bank with your trust document and take over.

Day one: account access restored. Properties managed. Tenants notified. Decisions made. No judge. No attorney permission. No waiting.

Does your successor trustee know they're named? Do they know where the document is?

Comment PROBATE if you want help setting this up right.

Legacy must be conscious. It must be directed. It must be planned.

The families that navigate loss well aren't the lucky ones. They're the planned ones.

You built the portfolio. The last thing it deserves is a court process, a family dispute, or a structure that never got updated.

Comment PLANNING and let's build something that outlasts you.

Are heirs limited to children, or can extended family inherit too? πŸ‘¨β€πŸ‘©β€πŸ‘§β€πŸ‘¦

Great news , you have more flexibility than you might think.

Your heirs are NOT limited to just your children. With a proper estate plan, you can leave assets to virtually anyone.

Here's who can be a beneficiary:
βœ… Children and grandchildren
βœ… Siblings, nieces, nephews
βœ… Close friends
βœ… Charities and organizations
βœ… Even pets (through a pet trust!)

Without a plan, state law decides who inherits , and it follows a strict order:
1️⃣ Spouse
2️⃣ Children
3️⃣ Parents
4️⃣ Siblings
5️⃣ Extended family

If you want YOUR wishes honored , not the state's default , you need a trust or will in place.

Being sued after a car accident , will your 403(b) be safe? πŸš—βš οΈ

Getting served with a lawsuit is terrifying. But here's some good news about your retirement account.

In most cases, your 403(b) plan IS protected from creditors and lawsuits. Here's why:

βœ… Federal ERISA protections shield employer-sponsored retirement plans
βœ… 403(b) plans typically have strong creditor protection
βœ… Judgment creditors generally CANNOT seize these funds
⚠️ BUT , protections vary by state and plan type
⚠️ Rolled-over funds to an IRA may have different (weaker) protections

The key takeaway: Don't panic, but DO get proper legal advice. Your retirement savings may be safer than you think , but only if you handle it correctly.

Can a trust be contested? πŸ§‘β€βš–οΈ

Yes , but it's significantly harder to contest a trust than a will.

Trusts are private documents that don't go through probate court, which already makes them more difficult to challenge. But that doesn't mean they're bulletproof.

Here's when a trust CAN be contested:
⚠️ The creator lacked mental capacity when signing
⚠️ There was undue influence or coercion
⚠️ The trust wasn't properly executed
⚠️ Fraud was involved

Here's how to PROTECT your trust:
βœ… Work with an experienced estate planning attorney
βœ… Include a no-contest clause
βœ… Document capacity at the time of signing
βœ… Keep your trust updated

When did you last have a Florida attorney actually review your investment structure?

Not when you formed the LLC. When did someone look at the whole picture, entities, titles, estate plan, how you're actually operating?

Your portfolio grew. Your exposure grew with it. The structure you set up in year 1 has gaps in year 5.

What's the difference between a revocable trust and an irrevocable trust? βš–οΈ

This is the #1 question we get , and understanding the difference could save your family thousands.

REVOCABLE TRUST:
βœ… You maintain full control
βœ… Can change beneficiaries, trustees, or terms anytime
βœ… Avoids probate but does NOT protect from creditors

IRREVOCABLE TRUST:
βœ… Assets are removed from your estate
βœ… Provides strong creditor and lawsuit protection
βœ… Can reduce estate taxes
⚠️ Much harder to change once established

Which one is right for you? It depends on your goals , probate avoidance, asset protection, or both.
