FAQ #1 Lately: Attorney Foley, do I need to be worried about ICE picking me up if I am traveling in the US even though I have legal status?

A: Unfortunately, I cannot safely say that anyone - even those who are US Citizens - can travel without worries about ICE / Customs and Border Patrol bothering them these days. They are everywhere and they are openly harassing people.

FAQ #2: What can I do to protect myself and my family?

A: Develop a relationship with a trustworthy immigration attorney, if you haven't already. Then, familiarize yourself with your rights and carry your State ID and NO INDICATORS OF YOUR NATIONALITY or immigration status. Should you be questioned, exercise your RIGHT TO REMAIN SILENT by providing your name and ID and nothing else. If they persist, tell them that you will not speak to them about your immigration status without your attorney present and give them an attorney's contact information. Here is a printable "Know Your Rights" card that you can carry with you, as well. Feel free to write my contact info on it!

Per our siblings in struggle at Florida For All: SHELTERS SHOULD NOT BE CHECKING IDS, so if you don't have an ID for any reason (immigration status, lost your papers, name or gender marker mismatch...), do not let this stop you from getting to safety! If you hear of any issues, please report them to your state reps!

SB1718 is one of many hateful new laws in Florida attacking the rights of foreign nationals, women, the LGBTQ++ community, people of color, and essentially anyone the MAGA crowd deems "other". Last week, I was honored to participate in a panel with other experts and activists to talk about the effects on our communities and how we can fight back. ✊❤️

The latest in Florida's cruelty towards "others" will negatively impact us all starting with tanking our state's immigrant-dependent economy.

In May 2023, the Florida governor signed into law a comprehensive effort to restrict the ability of undocumented individuals to live and work in Florida. AILA has provided a summary of the major provisions of FL 1718, which will take effect on July 1, 2023.
