If you testify at trial in a way that conflicts with your deposition testimony, the opposing attorney can use your prior statements to challenge your credibility. They may point out the inconsistency — essentially asking, “Were you untruthful then, or are you being untruthful now?” It’s important that your testimony remain consistent. That’s why it’s important to review all of your pleadings and important paperwork prior to the deposition. It’s also important to meet with your attorney so they can explain the process to you in detail so that you feel prepared for your deposition.

During divorce you may hear language that you are not familiar with. A subpoena is a legal document that commands a person or entity to testify as a witness at a specified time and place (at a deposition, trial, or other hearing), and/or to produce documents or other tangible objects in a legal proceeding. Subpoenas are time-sensitive with court-imposed deadlines. Failure to comply with a valid subpoena could result in the person refusing to properly respond being held in contempt of court.

After you and your spouse reach an agreement, settlement documents are prepared and approved by both parties and their attorneys. Once completed a court date is scheduled for the final “prove up” for the judge to approve the agreement to make sure both parties have entered into the agreement freely and voluntarily. Once the judgement is entered after the prove up, you are formally and legally divorced and must be bound by all of the terms and provisions of the agreement.
