On Friday, the U.S. Supreme Court overturned the decades-old Chevron doctrine of judicial deference to a federal agency’s interpretation of an ambiguous statute. Impacts are expected to include everything from the environment to public health and more.

Loper Bright Enterprises v. Raimondo, No. 22-451; Relentless, Inc. v. Department of Commerce, No. 22-1219 – Decided June 28, 2024

The Supreme Court has upended a 40-year-old decision that made it easier for the federal government to regulate the environment, public health, workplace safety and consumer protections.

This past month, the Environmental Management bill (HB 965) was signed into Florida law. This law authorizes the creation of water quality enhancement areas (WQEAs), which are natural systems constructed, operated, managed, and maintained for the purpose of providing offsite regional treatment. These WQEAs must be used to address contributions of one or more pollutants or other constituents in the watershed, basin, sub-basin, targeted restoration area, or waterbody that do not meet applicable state water quality criteria. The law also authorized the use of enhancement credits for specific purposes related to these WQEAs. Additionally, HB 965 revised requirements for developers and homebuilders to qualify for graywater technology incentives.

Florida legislation (HB 1475) has just been signed into law requiring the Florida Department of Environmental Protection to adopt statewide cleanup target levels for Perfluoroalkyl and Polyfluoroalkyl (PFAS) in soil, drinking water, and groundwater by 2025. PFAS are a group of thousands of man-made chemical compounds developed for a multitude of everyday products ranging from non-stick pans to firefighting foams. PFAS are now known to be more dangerous to human and environmental health than previously thought and can now be found in water, air, fish, soil, and in the blood 99% of Americans.

Florida's Clean Waterways Act was enacted almost two years ago. It created a wide range of water quality protection provisions aimed at minimizing the impact of known sources of nutrient pollution and strengthened regulatory requirements. These nutrient pollution sources include septic systems, stormwater runoff, wastewater treatment plants, as well as fertilizer used in agricultural production.
