Special Powers of an Association During an Emergency

August through October is the busiest part of the Atlantic hurricane season! Does your community have an emergency plan in place?
Condominiums and homeowners associations both have emergency powers that are triggered when the Governor declares a state of emergency. Some of these powers include the ability to:
- Implement a disaster or emergency plan;
- Conduct meetings by telephone or videoconferencing;
- Close off access to parts of the property;
- Contract for treatment to prevent the spread of fungus, mold, or mildew;
- Levy special assessments without the vote of owners, even if doing so is specifically prohibited by the association’s governing documents;
- Borrow money without owner approval to fund emergency repairs and to cover association operation.

The Law firm of Wetherington Hamilton, P.A. is pleased to announce that its founding partner, Theodore Hamilton, Esq., will be inducted as President of the Commercial Law League of America at its annual conference to be held in Chicago, Illinois on May 15th-18th. The Commercial Law League of America, established in 1895, is celebrating 130 years of history and is an association of commercial lawyers, including creditors' rights attorneys, bankruptcy attorneys, commercial collection agencies, and legal network personnel.

Theodore Hamilton has been active in the Commercial Law League since 1996 and is excited to embark on his year as President.
