The FDD is the one document that tells you what you're actually agreeing to when buying a franchise. But it's long, technical, and comes with a deadline.

Under the FTC Franchise Rule, the franchisor must give you the FDD at least 14 calendar days before you sign or pay. That window exists so the document can be reviewed. Earnings claims made outside of Item 19 and promises that contradict what the FDD says are potential red flags worth investigating before signing, not after.

Overtime problems rarely announce themselves. They show up as a job title that does not match the actual duties, as prep or cleanup time that never reaches the timesheet, or as a bonus that was left out when the overtime rate was calculated.

A franchisor can deliver the FDD late or make earnings claims outside Item 19 and still leave the buyer without a federal claim. The FTC Franchise Rule sets the disclosure standard, but only the FTC can enforce it.

H.R. 4614, the Franchisee Freedom Act, would change that. The bill would let harmed franchisees sue directly for Franchise Rule violations, seek damages or rescission, recover attorneys' fees and costs, and file in their home state. It would also bar franchisors from restricting or retaliating against franchisee association activity.

The bill remains in committee, and it does not address arbitration clauses or class waivers. Until it moves, franchisee remedies still come from state franchise statutes, common law fraud, and FTC complaints.
