“My child is old enough to choose which parent they want to live with. So, can they just tell the judge?”

Not exactly.

In Florida, there is no specific age when a child gets to decide which parent they will live with. However, a child’s reasonable preference can be considered by the court if the court determines the child has enough intelligence, understanding, and experience to express that preference.

And this is important: your child’s preference is only one factor. The court’s primary consideration is the child’s best interests.

When you’re going through a divorce, getting your documents, information, and paperwork to your attorney on time can make a big difference in keeping your case moving forward.

And if your attorney asks for something, “I’ll send it right over” should probably mean... right over. 😂

Communication matters. So does staying on top of the things your attorney needs from you.

You may be absolutely convinced your ex is a narcissist.

You may have years of messages, arguments, broken agreements, and frustrating conversations that make you think, “How am I supposed to explain all of this to a judge?”

Here’s the thing: I wouldn’t walk into court and simply say, “Your Honor, my ex is a narcissist.”

I’d show the court the behavior behind the label.

Did they repeatedly ignore messages about your child?
Do they change their story when it’s convenient?
Do they refuse to follow the parenting plan?
Do they make reasonable co parenting nearly impossible?

Document it.

Keep the messages. Save the emails. Write down the dates and what happened. Most importantly, look for the pattern.

Because in family court, specific facts and evidence are far more useful than a label.

Florida courts consider a number of factors when making decisions about parental responsibility and time sharing, including each parent’s ability to communicate, cooperate, honor the parenting schedule, and act in the child’s best interests.

So instead of trying to convince the court that your ex is a narcissist, show the court what they are actually doing.

Let the behavior speak for itself.

$14,000 a month. A child he says he’s never met. And no plans to exercise parenting time.

That might make you ask: If a parent doesn’t see their child, why would they still have to pay child support?

Because in Florida, child support and parenting time are two different legal issues.

Child support is a financial obligation to help meet a child’s needs. Parenting time addresses when and how a parent spends time with their child.

They can affect each other in certain circumstances, especially when it comes to how child support is calculated, but choosing not to exercise parenting time does not simply make a child support obligation disappear.

Florida law specifically provides that a parent’s failure to exercise court-ordered time sharing does not automatically eliminate their child support obligation.

And it works the other way, too. Child support and parenting time are separate responsibilities. One parent generally cannot withhold parenting time simply because the other parent has fallen behind on support.

Family law is rarely as simple as “I don’t see my child, so I don’t have to pay.”

If you’re dealing with child support or parenting time questions, get advice based on the specific circumstances of your case.
