One case. Two prosecutions. How can that happen? โš–๏ธ

Luigi Mangione pleaded guilty in federal court to two stalking charges related to the 2024 killing of UnitedHealthcare CEO Brian Thompson. During the plea hearing, he also admitted that he shot Thompson.

Mangione still faces separate murder and weapons charges in New York state court. However, the state trial that was scheduled to begin September 8 has now been postponed indefinitely.

Why? Mangioneโ€™s attorneys are asking the state court to dismiss the case on double jeopardy grounds, arguing that the federal prosecution and the state prosecution are based on the same underlying conduct.

This is where the legal issue gets complicated. The federal government and state governments are generally considered separate sovereigns, which can allow separate prosecutions in some circumstances. But whether that principle permits the New York prosecution to continue in this particular case is now being challenged in court.

The judge has given prosecutors until October 9 to respond to the dismissal motion, with the next state-court hearing scheduled for December 10.
