Walking into your first mediation session without knowing what to expect makes an already stressful situation harder than it needs to be.

If you’re heading into mediation, familiarize yourself with these basics so you can walk in confidently:

- Both parties meet with a neutral mediator whose job is to guide the conversation, not take sides or make decisions
- Typically sessions are no shorter than two hours and they can go for eight hours or more. The complexity and numbers of matters mediated typically determine the timeline
- The mediator will help clarify where you agree, where you don't, and possible options for resolution
- You won't often be in the same room - private caucasus are common
- Having handy financial documents, a parenting calendar if children are involved, a written list of your priorities, and your draft first offer of settlement expedites mediation

If you want even more preparation, the full breakdown of what to expect during your first mediation session is live on my blog.

How far into a case do you get before you realize you need backup? The sooner you get there, the more options you have.

When you build litigation support into a complex case from the beginning, you can account for it in your fee structure and maintain the quality your clients expect without sacrificing your own bandwidth.

Here's how to recognize when it's time and what to look for when vetting the right person: https://www.kayfamilylaw.com/2026/02/10/how-to-identify-when-you-need-litigation-support/

I work with attorneys who need experienced backup on complex cases. If you want to talk through what that looks like, let’s connect.

There has probably been a case you should have declined, a client you kept longer than made sense, and a weekend you worked because no boundary was ever set.

Most of the stress, inefficiency, burnout, and compassion fatigue in legal practice traces back to those moments.

Saying no clearly and early is one of the most consequential skills you can build. That means paying attention to how a potential client behaves before you've signed anything, recognizing when a case will cost more than the fee justifies, and addressing scope creep as soon as you see it rather than six months later.

Your practice accumulates clutter just like your closet does. The question is how to fix it when you're buried in client work.

You don’t have to start from scratch. Small, strategic improvements create immediate relief. This is how to begin with intake and file management.

Adversarial proceedings don't have to abandon compassion. A trauma-informed approach recognizes that effective advocacy means working with trauma responses rather than against them.

Clients sometimes need time to regulate before making important decisions, and clear explanations about legal processes can significantly reduce their anxiety. When we use language that promotes safety instead of triggering defensive reactions, we get better outcomes.

This benefits attorneys as much as clients. Legal professionals who understand trauma can improve client relationships, strengthen legal advocacy, and enhance their own well-being.

Here’s an overview of how a trauma-informed approach can elevate your legal practice: https://www.kayfamilylaw.com/2025/12/16/trauma-informed-legal-approach/

These principles make legal proceedings more productive while respecting the dignity of everyone involved, which is why I speak on trauma-informed practice regularly at CLE events.

Divorce is painful, and no one expects you to feel nothing during mediation. But sessions produce legally binding agreements that will shape your life for years. Digging in on an issue out of anger tends to cost more than it's worth. So does agreeing to something just to end the session.

Many people find it helpful to work with a therapist or counselor alongside the mediation process to avoid the mistake of letting your emotions drive decisions. Having a separate space to process the emotional weight means you can show up to sessions more focused on the practical decisions at hand.

Be wary of these additional mediation mistakes I often see in divorcing couples: https://www.kayfamilylaw.com/2026/03/24/5-common-mistakes-divorce-mediation/

If you’re looking for an alternative route to divorce, I help clients navigate mediation with clarity and confidence. Find a time to get started on my mediation calendar.

POV: Your practice feels like controlled chaos on a good day.

When operations are disorganized, you spend more time managing the chaos than actually practicing law, and the cost goes beyond wasted hours. Scattered systems create liability risks, drain your energy, and prevent growth.

If this sounds like you, check to see if you recognize any of these other signs you may need a legal business coach: https://www.kayfamilylaw.com/2025/11/17/5-signs-you-need-a-legal-business-coach/

I coach attorneys to implement streamlined workflows and accountability systems that transform daily operations. You'll develop processes that work without requiring you to be in the weeds constantly. Contact me to learn more about my coaching availability.

Divorce mediation requires both parties to make real financial decisions, but those decisions are only as good as the information behind them.

Before your first session, collect all your financial information to prevent costly mistakes and agreements built on faulty assumptions.

Check out four other common mistakes I see in divorce mediation here: https://www.kayfamilylaw.com/2026/03/24/5-common-mistakes-divorce-mediation/

I guide clients through mediation preparation to ensure they walk in ready to negotiate effectively. If you’re ready to get started, schedule a time on my mediation calendar on my website.
