Have you made your 2025 tax-free gifts, and are you considering tax-free gifts in 2026?

Each year, the IRS sets the annual gift tax exclusion, which allows a taxpayer to give a certain amount (which is remaining the same in 2026 as in 2025, at $19,000) per recipient tax-free without using up any of the taxpayer’s lifetime gift and estate tax exemption (which is increasing to $15 million per person in 2026). For married couples, this means that they can continue to gift-split in 2026 to give $38,000 per recipient per year tax-free.

There are only a couple of days remaining in 2025 to make tax-free gifts, and 2026 tax-free gifts can be made as soon as January 1st.

Many individuals choose to utilize trusts for privacy. In Florida, assets placed in a trust before death are not subject to probate and are not listed on a probate inventory for the public to see. And unlike last will and testaments, trusts are not filed with the probate court in Florida, thus the trust beneficiaries and their specific gifts or percentages are not available for the public to see. I would imagine that privacy was one of the main reasons Jimmy Buffett utilized trusts in his estate plan. Unfortunately, privacy was not achieved due to the inability of the designated co-trustees to get along. With each co-trustee suing for the removal of the other co-trustee, it appears his trust may not have given certain individuals the power to remove and replace trustees. Choosing trustees and considering and planning for potential conflicts among trustees are some of the more important decisions to make when creating or amending a trust.

As part of an estate plan, individuals often want to name one or more family members as the beneficiaries of their closely held business interests. Are they able to do so? It depends. The entity’s controlling documents or even the type of entity itself could have ownership restrictions, right of first refusal requirements, and transfer restrictions. Can those restrictions be removed? Sometimes. When creating or updating an estate plan, it is important to have copies of the controlling documents of a closely held business.
