Weekly Legal Tip ⚖️ If you’ve been injured in a car accident, here are 3 important things to do:

1) Call law enforcement to the scene who will investigate & write a report (i.e. I was contacted last week by a woman who was in a car accident in which the at-fault driver said he was late for a meeting & couldn’t wait. So, they exchanged information but did not call law enforcement. Later, the at-fault driver claimed the woman caused the accident).

2) If injured or think you may be injured, immediately seek medical care from a doctor, nurse, etc. at medical facility because, if you don’t seek medical care within 14 days, your personal injury protection from your car insurance can decrease by 75%.

Legal Tip of the Week ⚖️

Presently, you can approach & video record first responders such as law enforcement, firefighters, paramedics, etc. while they are performing their duties.

However, on January 1, 2025, a new Florida law will make it illegal, after you have been verbally warned, to approach a first responder or remain within 25 feet while the responder is performing a legal duty with the intent to: a) block or interfere with their ability to perform the duty; b) threaten the first responders with physical harm; or c) harass the first responder.

“Harassment” is defined as an action that intentionally causes substantial emotional distress in the first responder and serves no legitimate purpose.

The new law will not prevent videoing or taking pictures, but it does require you, if asked, to move 25 feet away.

Legal Tip of the Week ⚖️

You’ve either experienced it or done it yourself: ROAD RAGE! So, does Florida have a law against road rage? The answer is both yes & no. 

Florida neither has a specific law addressing road rage nor a law that defines road rage; however, Florida does have an “Aggressive Careless Driving” statute (Section 316.1923) which defines aggressive driving as driving while committing any two of the following:

1) Speeding
2) Improperly or unsafely changing lanes
3) Tailgating
4) Failure to yield
5) Improper or dangerous passing
6) Failure to obey traffic control devices

BUT there is no penalty for violating this law. It’s essentially kept on the books as a method to track statistics on car accidents involving aggressive driving.

Of course there are Florida laws for Careless Driving (Section 316.1925) which is a traffic infraction and Reckless Driving (Section 316.192) which is a criminal violation. Now you know!

LEGAL TIP OF THE WEEK ⚖️: Florida’s “Move Over” law changed this year. While driving, you must ‘move over’ a lane — when you can safely do so — for stopped law enforcement, emergency, sanitation, utility service vehicles, tow trucks, maintenance or construction vehicles with warning lights, and ANY DISABLED VEHICLE on the side of the road.

If you can’t move over — or when on a two-lane road — you must slow to 20 mph less than the speed limit. If the speed limit is 20 mph or less, you must slow to 5 mph. (See Fla. Stat 316.126). Now you know ⚖️

After years of litigation, this week the jury awarded my client over $11.5 million dollars for horrific injuries she suffered in a vehicle crash caused by a semi-truck.

Legal Tip of the Week ⚖️

With a lot of rain expected on Sunday, the roads will be slippery. If you are unfortunately injured in a car accident and go to a doctor or medical facility, make sure to give them your car insurance information. This way, your personal injury protection (PIP) coverage will pay your medical bills. PIP pays 80% of medical bills and 60% of lost wages up to $10,000.

WEEKLY LEGAL TIP ⚖️: If you like blasting your music from your vehicle, you should be aware of a Florida law that went into effect this year: F.S. 316.3045 - Operation of radios or other mechanical or electronic devices or instruments in vehicles. ❌🚫🎶

In essence, the law prohibits the driver or occupant of a vehicle from amplifying the sound from a radio, tape or disc player, portable music or video players, cell phones, tablets, laptops, musical instruments, etc. in which the sound is “plainly audible at a distance of 25 feet or more from the motor vehicle or is louder than necessary for the convenient hearing by persons inside the vehicle in areas adjoining private residences, churches, schools, or hospitals.”

So, an officer using "ordinary auditory senses," who has a "direct line of sight and hearing" to identify the vehicle, can conduct a traffic stop on the vehicle & issue a traffic citation.

The law does not apply to law enforcement vehicles and emergency vehicles using sirens & does not apply to a vehicle’s horn or other warning device such as an anti-theft alarm.

(Of course my real concern is that now I won’t know when the ice cream truck is coming down the street 🍦😔)
