HTBPT is calling for the resignation of St. Louis Circuit Attorney Kim Gardner due to her lies and her inflammatory comments intentionally made to support her bias against law enforcement as well as her actions of summoning an investigator from her office to the scene that did not involve him.
Ms. Gardener’s comments violate the following rules of professional conduct regarding the Missouri Bar:
RULE 4-8.4: MISCONDUCT (c) engage in conduct involving dishonesty, fraud, deceit, or misrepresentation. It shall not be professional misconduct for a lawyer for a criminal law enforcement agency, regulatory agency, or state attorney general to advise others about or to supervise another in an undercover investigation if the entity is authorized by law to conduct undercover investigations, and it shall not be professional misconduct for a lawyer employed in a capacity other than as a lawyer by a criminal law enforcement agency, regulatory agency, or state attorney general to participate in an undercover investigation, if the entity is authorized by law to conduct undercover investigations;
(d) engage in conduct that is prejudicial to the administration of justice;
Per this article, Ms. Gardner was stopped by law enforcement for failure to user her headlights while driving. Ms. Gardner was let go within 6 minutes of the initial stop with a warning. Ms. Gardner went on public record afterwards, regarding this traffic stop taking longer than necessary. Ms. Gardner stated she was detained for over 15 minutes. Video surveillance showed the stop took approximately 6 minutes. Ms. Gardner was stopped based on her headlights as stated, but has gone one public record saying the stop was for intimidation, a claim with zero evidence to back it up. This claim violates article (d), her statement was prejudicial to the administration of justice for her traffic violation. Based on this evidence, Ms. Gardner is not being truthful regarding the entire encounter.
I believe Ms. Gardner called an investigator that works in her office. This investigator then allegedly interfered with the ongoing traffic stop. If it can be show she called this investigator, this conduct absolutely violated article (d) as noted.
Ms. Gardner’s actions are untruthful and they misrepresent the actions of law enforcement that took action on the night of December 23rd, 2019. Her public dishonesty has brought discredit to her office and the legal profession.
