Still smiling from last week's South Florida Business Leaders’ Luncheon honoring Mike Colodny as the 2026 South Florida Business Leader of the Year.

More than 200 leaders from the business, legal, maritime, and South Florida communities came together to recognize Mike and support Seafarers' House at Port Everglades and its important mission serving the maritime community.

Florida’s 2026 Legislative Session ended earlier in March without a finalized state budget and with fewer bills passed than in recent years.

So what actually got done, what stalled, and what comes next?

With 1,926 bills filed and just 237 passed, this session highlights divisions on key policy issues and leaves several priorities unresolved, including the state budget.

We are pleased to share a recent summary judgment victory on behalf of our client, TypTap Insurance Company.

This matter involved a first-party property claim for Hurricane Milton damage, reported by a public adjuster who submitted a replacement cost (“RCV”) only estimate totaling more than $90,000.

TypTap afforded coverage for covered damages, issuing payment in accordance with the Policy, less deductible, based on its actual cash value (“ACV”) estimate. The Coverage Determination Letter stated that the payment did not necessarily constitute full and final settlement of the claim and requested notification of any additional loss or damage.

At no time prior to filing suit did the insureds or the public adjuster submit a competing ACV estimate to dispute TypTap’s coverage determination, nor did they provide any evidence showing proof of repairs to any covered property which would trigger any further payment obligation.

The Court ruled in favor of TypTap since pursuant to the Policy, TypTap was only required to pay the actual cash value amount of the loss prior to repairs, and Defendant made that payment in accordance with the Policy. Thus, there was no breach of the Policy prior to plaintiffs’ filing of the lawsuit.

Congratulations to our client, First Protective Insurance Company (“Frontline”), in obtaining a summary judgment victory in a hotly contested late-reported windstorm claim.

The week before trial was set to start, Colodny Fass Associate Rebecca LoPresti, Esq., and Shareholder Maria Abate successfully convinced the Honorable Heather Doyle in Manatee County that Plaintiff had no evidence to prove the damage occurred during the policy period.

Ms. LoPresti asserted that Frontline was entitled to summary judgment as a matter of law because the undisputed facts established that Plaintiff did not discover any damage until after the expiration of the policy period.

Ms. LoPresti successfully defeated Plaintiff’s opposition to summary judgment, in the form of an expert affidavit, by establishing that the affidavit was conclusory and internally inconsistent, as it relied on documentation of alleged wind damage from photos taken years after the alleged date of loss, and well past the policy’s expiration.

The Court agreed and dismissed the action, based, in part, on the holding in Gonzalez v. Citizens Property Ins. Corp., 273 So.3d, 1031, 1034 (Fla. 3d DCA 2019) (expert affidavit which is conclusory and internally inconsistent cannot be considered by the Court to defeat summary judgment).
