The cases against OSHAs vaccine mandate throughout the country were consolidated before the 6th Circuit Court of Appeals. The Appeals Court has upheld OSHAs vaccine mandate by a 2-1 vote. The issue of whether OSHA has the power to create a vaccine mandate is now likely headed to the Supreme Court.

My personal guess is that the Supreme Court will either uphold OSHAs vaccine mandate or choose not to hear the case, but I don’t have a high degree of confidence in that guess.

Not the correct way to provide a person final pay...

A Georgia man said his former employer owed him a pretty penny, $915 to be exact, after leaving his job in November. Atop the pile was an envelope with Flaten's final paystub and an explicit parting message. “This is a childish thing to do,” Flaten said.

This job really tugs at your heart strings and I know I can’t help everyone that calls. Sometimes I have to reject viable potential cases because I’m dealing with other matters and want to give the best service to every current client.

It’s so hard because a lot of times I really connect with the people I talk to and my soul just tells me to call them back and take the case. Today, I had one of those calls and It felt like such reaffirmation on a bad day. The sweet client said she understood my situation and thanked me for my time and explanation of the law.

As a lawyer who works on discrimination issues, I feel this excerpt of Amanda Gorman's inaugural poem "The Hill We Climb" captures the spirit and function of the laws enforcing equality in this nation and thought I'd share:

For employees in Texas earning $50,000+ who were recently laid off, unemployment will be paying about $800 a week ($300 extra) starting soon in light of the passage of the stimulus package.

Employees who receive severances should consult a labor & employment attorney BEFORE signing, because normally a severance will prevent an employee from collecting unemployment, but there are LOOPHOLES. The stakes are high when you have lost your job and every dollar matters. Thousands of dollars are at stake for these employees.

Spread the word and don't let the grinch take unemployment you or your friend may be entitled to.

I don’t expect many employers outside of healthcare to have policies requiring vaccinations, but it is legal to have a policy as long as there are some accommodations for unique health circumstances.

The federal Equal Employment Opportunity Commission said employees could be barred from the workplace if they refused the vaccine.
