Per the support agency, you can seek a child support modification every three years. However, you can also seek a modification if there has been a change in circumstances that would affect the calculation. Normally this means change in either parent's income, but could also mean changes in childcare or insurance costs. Anything that will swing the amount 10% will result in a modification.

If you are married and going through a divorce/separation, both parents have "custody" until a court says otherwise.

If you are not married, Ohio law says that the mother has full custody until a court says otherwise. This includes visitation rights.

Not many people do it, but the best time to come up with a custody arrangement may be before things get bad. It may be difficult to discuss in the moment, but we do other prudent things to prepare for the worst, such as making wills.

On that note, can also help with making wills.

Three days in a row of in-person court appearances. Nice that things are getting back to normal, but maybe we do normal when it is not 15 degrees outside.

Hey everybody. Just a heads up that I will be out of the office until January 25th. Will return all calls, emails, smoke signals and carrier pigeons at that time, but I do ask that you be patient. Usually takes me a day or two to dig out. --Bob

Got all dressed up. Drove to court. Got told they need to reschedule. Finally feels like the pre-Covid days again.

I have been asked multiple times on both sides of the issue how to deal with custody and visitation exchanges during these times. There is not a clear answer. No one anticipated these circumstances when standard orders or specific parenting plans were written. Further, most of the courts are working reduced schedules so we are limited in how to even address the issue.

That said, in reviewing Ohio's Stay at Home Order, "essential travel" includes "Travel required by law enforcement or court order, including to transport children pursuant to a custody agreement."

This obviously cannot cover all scenarios, but absent exigent circumstances, it seems the default position is to continue to follow your parenting schedules. Your specific situation may not be as straight forward.

Please stay safe everyone,

Bob
