In Louisiana, property rights and distribution in divorce are governed by community property laws. There are two main categories of property: community property and separate property.

Community Property includes real and personal property that falls into the following categories:

πŸ‘‰Acquired during the marriage by either spouse.
πŸ‘‰Acquired using other community or separate property.
πŸ‘‰Donated (or gifted) to both spouses jointly.
πŸ‘‰Produced by other community property, including royalties and interest, unless claimed as separate property.
πŸ‘‰Awarded as damages for the injury or loss of other community property.

Separate Property consists of property acquired before the marriage or during the marriage from personal gifts, inheritances, insurance, or personal injury settlements. Separate property remains the exclusive right of the individual and is not divided during divorce.

In a divorce, each spouse holds a 50 percent interest in all community property. If there's no agreement between the spouses on how to distribute community property, or if there's no prenuptial agreement in place, the court may decide to evenly distribute it among them.

For assistance with property division or any legal matters related to divorce, Ethan P. Arbuckle, Attorney at Law, LLC, is here to provide guidance and representation. πŸ βš–οΈπŸ€

πŸŒŸπŸ“š Fun Fact Friday with Ethan P. Arbuckle, Attorney at Law, LLC πŸ“šπŸŒŸ

Did you know? In the legal world, there's a term called "Stare Decisis," which is Latin for "to stand by things decided." It's a fundamental principle that underpins our legal system.

Stare Decisis means that decisions made by higher courts serve as legal precedents and must be followed by lower courts when dealing with similar cases. This helps ensure consistency and fairness in the application of the law.

So, the next time you hear about legal precedents, remember that it's all about standing by things decided! If you have legal questions or need guidance, I'm here to help. Have a fantastic Friday! πŸ€βš–οΈπŸŒŸ

πŸ‘¨β€βš–οΈπŸ‘§ Child Support Matters in Louisiana: Insights from Ethan P. Arbuckle, Attorney at Law, LLC πŸ‘§πŸ‘¨β€βš–οΈ

Child support is a crucial aspect of family law, and understanding the nuances of child support in Louisiana is essential for parents and guardians.

Even if you don’t earn primary physical custody over your children in a divorce, you still have legal obligations to their development and health. The court may order the non-custodial parent to pay child support until the child turns 18 years old, becomes emancipated or graduates high school before reaching 19 years of age.

Child support is calculated using both parents’ combined adjusted gross monthly income and the number of children in need of support. Visitation (called β€œparenting time” in Louisiana) doesn’t factor into child support calculations. The noncustodial parent may not legally withhold child support payments and the custodial parent may not legally deny the other parenting time for nonpayment without court intervention.

πŸ’” Protect Your Loved Ones with Estate Planning πŸ’ΌToday, we want to share a poignant example of why having a will and testament in place is absolutely crucial. Unfortunately, this story illustrates the real consequences when good intentions aren't supported by good estate planning.

Imagine this: A husband who dearly loved his wife wanted to ensure her financial security after he passed away. He wished for her to have the support she needed to thrive. However, despite these heartfelt intentions, he did not have a will declaring these wishes.

The result? His half of the estate went to his children from a prior marriage, leaving his beloved widow in a serious jam. πŸ’”

This story serves as a powerful reminder that good intentions alone cannot guarantee the financial security and well-being of your loved ones. Estate planning may not be something we eagerly anticipate, but it is an essential step to prevent heartbreaking situations like these.

Don't wait. Take the time to plan for your family's future today. Reach out to us, and we'll guide you through the process with care and expertise. πŸ“œ

Your peace of mind and your loved ones' security are worth every effort. Let's work together to create a plan that reflects your wishes and protects those you cherish.
