Before your plants are in the ground, your compliance foundation needs to be solid:
▪️ Confirm all METRC entries are accurate — plant count, strain-specific designations, and planting orientation tagged and logged correctly from day one
▪️ Review all compliance documents, license and permit certificates, and SOPs — if anything is outdated or missing, address it now
▪️ Consider a proactive inspection before regulators schedule one — identifying potential violations on your own timeline is always better than on theirs

At-will employment does not mean what most California cannabis employers think it means.
At-will means you can terminate without a stated reason. It does not protect you from claims that the termination was retaliatory, discriminatory, or part of a pattern that created an intolerable work environment.

Where operators get exposed:
▪️ Termination follows a protected complaint — wage issues, safety concerns, discrimination — and the employee asserts retaliation
▪️ Working conditions deteriorate after a complaint and the employee resigns — this is constructive termination, and it carries the same exposure as a wrongful termination claim
▪️ Discipline was applied inconsistently across employees — this creates disparate treatment exposure regardless of at-will status

The best protection is documentation that exists before any dispute arises. Clear role expectations at hiring. Consistent written performance reviews. Documented disciplinary records. Signed acknowledgment of policies and procedures.

The administration signed an executive order on psychedelic research, allocated $50 million toward veteran treatment programs, and had the president publicly pressing his own officials on cannabis rescheduling — all in the same Oval Office event.

The direction of federal drug policy is shifting faster than at any point in a generation. Cannabis rescheduling is not finished. The rulemaking process still has to run its course, and the legal challenges will come.

But the political environment around cannabis has changed. Operators who have kept their compliance posture clean and their business structures sound are the ones positioned to move when the regulatory environment catches up.

The operators who are least surprised by DCC inspections are the ones who stay prepared for inspections at any time.

We continue to see the same pattern. A licensee runs well day-to-day. Operations are moving. Product is moving. Then the DCC shows up and finds documentation gaps, SOP deviations, or recordkeeping issues that have been accumulating quietly for months.

The cost of a proactive audit is predictable. The cost of a compliance failure — corrective action plans, license conditions, potential suspension — is not.

Schedule III is not legalization. Here is what operators actually need to understand before making any business decisions based on the news.

What a finalized Schedule III reclassification would change:
▪️ 280E tax treatment may ease for licensed medical operations
▪️ Federal research restrictions are reduced
▪️ State-licensed medical programs gain formal federal recognition

What it does not change:
▪️ Cannabis remains a federally controlled substance
▪️ Recreational Cannabis remains Schedule I
▪️ Interstate commerce is still a federal crime

The order is a step forward. It is not a finish line. The operators who move carefully and deliberately through this period will be the ones best positioned when the dust settles.

Most of them are preventable.

The issue is rarely the termination itself. It is everything leading up to it.

Operators who protect their business focus on:
📝 Structured onboarding with clear expectations
📝 Consistent performance management
📝 Documented communication at every stage

If it is not documented, it does not exist when it matters most.
