Big changes are coming to child custody law in Maryland.

Starting October 1, 2025, judges will use a new list of “best interest” factors written directly into the law when deciding custody cases. This change is designed to make decisions fairer, more consistent, and more transparent for families.

Parents will now have clearer guidance on what matters most to the court—things like stability, relationships, emotional and developmental needs, day-to-day care, and in some cases, the child’s own preference. Judges must also explain their reasoning, giving families more clarity and peace of mind.
