Many people still picture alimony as something a husband pays to a wife. But that assumption does not reflect how New York spousal maintenance law works.

Maintenance is gender-neutral. Depending on the financial circumstances of the marriage, a husband may be entitled to receive support from his wife. Courts may consider factors such as each spouse’s income and property, the length of the marriage, earning capacity, age and health, and whether one spouse sacrificed career or educational opportunities during the marriage.
